a) The seller accepts, declares, and undertakes that they own the property of the product(s) offered for sale on the site and/or are authorized to transfer the ownership, and that there are no legal or other barriers to the sale of the product(s) by themselves.
b) The seller has the right and authority to offer a product for sale on the site using the 'Buy Now' option at a fixed price previously disclosed. After the buyer has paid the product price to the Secure Account, the seller must enter the shipping information of the product to the site within 3 business days +24 hours.
c) Under the User Agreement and in accordance with site rules, if the buyer fails to fulfill their obligations or fails to deposit the product price into the Secure Account, the seller has the right to cancel the product at their own discretion without incurring any additional obligations or liabilities towards the buyer.
d) The seller accepts, declares, and undertakes that the product(s) offered for sale do not violate the User Agreement provisions, including Prohibited Products, or the rules and conditions of membership stated in certain parts of the site, and are in compliance with applicable legislation.
e) The seller accepts that they bear all legal responsibility for the products displayed on the site, that the products have been previously launched in Turkey and worldwide by the manufacturer or authorized sellers, and that Shopexi has no direct or indirect relationship with them in terms of product supply and sales under any title.
h) The seller accepts, declares, and undertakes that they are solely responsible for ensuring the products offered for sale on the site are not prohibited products; and for any liability arising from the sale, distribution, or any act related to offering the product for sale on the site being contrary to any applicable regulation.
ı) The seller accepts, declares, and undertakes that the buyer can request Shopexi to transfer the Product price in the Secure Account to the Seller's account after receiving the product; or can refuse the product sent by the Seller, return it, and request Shopexi to refund the Product price.
i) The seller accepts, declares, and undertakes, in accordance with the User Agreement, to send the product on time, undamaged, in accordance with the qualities stated on the site, free from defects, and that the sale of the product to the buyer, the transfer of ownership, and related rights and obligations are solely their responsibility.
j) The seller accepts, declares, and undertakes that the sale price sent to the Secure Account by the buyer will be transferred to the seller's bank account specified to Shopexi after deducting the VAT included Service fee commission and after the buyer fulfills the obligations stated in this Agreement's section 5.1.1(b); in this process, Shopexi will not perform any transactions or disposals on the buyer's money in the Secure Account on its own behalf.
k) The seller accepts, declares, and undertakes that Shopexi bears no responsibility or obligation in case the buyer decides to withdraw from purchasing the product at any stage of the buying-selling process and for any reason; and that the seller cannot demand any compensation or sale of the product to another based on the purchasing conditions created by the buyer who withdrew from the purchase, regardless of the method.
l) The seller accepts, declares, and undertakes to immediately compensate for any damages incurred by Shopexi in case of any violation of any provision in this Agreement; if there is money in the Secure Account, Shopexi can claim the damages from this amount without any notice and warning requirement.
m) The seller accepts, declares, and undertakes that they are solely responsible for any damages that may arise to buyers and third parties in relation to the products offered for sale, both during the sale process and after the payment has been made to them, and will cover all claims, lawsuits, rights, expenses, and attorney fees that may arise from failing to fulfill the obligations stated in the User Agreement. The right of recourse against the Seller for all attorney fees, compensations, and other claims arising from lawsuits brought by buyers and rights holders against Shopexi is always reserved.
n) The seller accepts, declares, and undertakes that Shopexi can use the information related to the user and the product offered for sale in accordance with the Consumer Protection Law and the Regulation on Distance Sales.
o) The seller accepts, declares, and undertakes that they are responsible for the accuracy of information related to the product and that Shopexi is not obliged to verify the accuracy of this information.
ö) The seller accepts, declares, and undertakes to comply with the Consumer Protection Law and the Regulation on Distance Sales, and not to perform any action or declaration that would restrict or eliminate these provisions. The seller accepts that all responsibility towards the buyer under the Consumer Protection Law is theirs, and that Shopexi bears no responsibility for any disputes, lawsuits, and claims arising between them and the buyer, and will act in accordance with the preliminary information form and distance contract provisions.
p) The seller is obliged to list the product(s) offered for sale in the correct and appropriate category considering the Bank Cards and Credit Cards Law and the regulations made under this law, as well as the Consumer Protection Law No. 4077 or other relevant legislation, and not to use unrelated keywords. The seller is personally responsible for all damages and losses, including administrative sanctions and fines that Shopexi may incur due to listing against the User Agreement, Bank Cards and Credit Cards Law and its regulations, Consumer Protection Law No. 4077, or other relevant legislation provisions. If Shopexi determines that the seller has misclassified the product(s) or provided misleading information and/or keywords related to the product(s), Shopexi has the right to remove these products from the site. The seller cannot claim any damages or losses from Shopexi for the removal of these products from the site.
